Moss, a Barack Obama appointee, ruled Monday that police could not force Accountability Now USA, a protest group, to stop displaying flags and signs bearing the slogan \u201c86-47\u201d because it amounts to free speech protected by the Constitution, the New York Times reported. <\/p>\n<div>\n<p>The White House has repeatedly claimed that the number \u201c86\u201d suggests a desire to kill Trump, who as the 47th president of the United States is represented by the number \u201c47\u201d in the phrase.<\/p>\n<\/div>\n<p>Neither Moss nor Merriam-Webster was having any of it.<\/p>\n<p>Moss referred to the dicitonary\u2019s definition of \u201c86\u201d as a term harking back to \u201c1930s soda-counter slang,\u201d meaning only to \u201cthrow out\u201d or \u201cto get rid of\u201d something, with no suggestion of any violence. <\/p>\n<p>Accountability Now USA has kept up a round-the-clock demonstration at an encampment in D.C. since April. The group has had several run-ins with law enforcement, including Secret Service officials who\u2019ve attempted to pressure them into taking down flags and signs displaying the sequence of numbers.<\/p>\n<p>A member of the group, when challenged about the phrase, is understood to have explained to agents \u201cthat I want Trump to live forever and rot in jail where he belongs,\u201d according to court filings cited by the NYT. <\/p>\n<p>Read more <a href=\"https:\/\/nationwideinterstatemovers.com\/?p=581\">Trump\u2019s Disastrous Concert Organizers Get Mystery Millions<\/a><\/p>\n<p>Moss wrote that it was \u201cdifficult to fathom\u201d how any \u201creasonable observer would view the flag as a true threat.\u201d He stressed that \u201cthe term \u201886\u2019 is used far more often to mean \u2018throw out\u2019 than \u2018kill,\u2019 and it appeared at a demonstration that was focused, of all things, on the constitutional impeachment and \u2018removal\u2019 of the president.\u201d<\/p>\n<p>The Justice Department did not immediately respond to request for comment.<\/p>\n<p>The protest collective\u2019s court victory comes as the Justice Department pursues a separate but related legal action against former FBI director James Comey. <\/p>\n<p>Comey faces charges of making a threat against the president\u2019s life after posting a photo of \u201c86-47\u201d to Instagram.
