Ultra-conservative justices Clarence Thomas, Neil Gorsuch, and Samuel Alito dissented, signaling they would have overturned a century and a half of citizenship rights.<\/p>\n<\/div>\n<p>\u201cThe 14th [Amendment] was never intended to allow any non-citizen to confer citizenship on her child (&amp; thereby skip the line) by delivering the baby here. This Court majority &#8211; esp the squish conservatives &#8211; all too afraid of being called \u2018racist\u2019 to find accordingly,\u201d Kelly wrote on X.<\/p>\n<p>She proceeded to make five other reposts and posts on the topic, including one from Fox News reporter Bill Melugin claiming that he \u201csaw a lot of women who were very obviously in late-term pregnancies who were crossing the river illegally, likely knowing that giving birth on U.S. soil would immediately give their child U.S. citizenship.\u201d<\/p>\n<p>Kelly also endorsed an idea proposed by former federal prosecutor William Shipley, who floated terminating a woman\u2019s visa if she becomes pregnant, and requiring medical care providers to report positive pregnancy tests.<\/p>\n<p>\u201cThis is the way,\u201d she wrote.<\/p>\n<p>Utah Sen. Mike Lee argued that \u201cwe\u2019re going to need a constitutional amendment\u201d to keep Trump\u2019s bid alive, but Kelly didn\u2019t seem optimistic.<\/p>\n<p>\u201cIt takes 38 states. We\u2019ll never get that. We needed this Supreme Court to have courage,\u201d she said.<\/p>\n<p>Read more <a href=\"https:\/\/nationwideinterstatemovers.com\/?p=2560\">Trump\u2019s Weird White House Fantasy Contains Awkward Confederate Detail<\/a><\/p>\n<p>Trump\u2019s executive order on birthright citizenship, which he signed the day he returned to the White House, argued that \u201cthe privilege of United States citizenship does not automatically extend to persons born in the United States.\u201d<\/p>\n<p>But Supreme Court justices held that, under the 14th Amendment, \u201cchildren born in the United States to parents unlawfully or temporarily present are \u2018subject to the jurisdiction\u2019 of the United States and are citizens at birth.\u201d<\/p>\n<p>\u201cCitizenship, then and now, was the right to have rights \u2014 to freely participate in our political community. The Framers of the Fourteenth Amendment extended that promise to \u201cevery free-born person in this land,\u201d Roberts wrote. \u201cWe keep that promise today.\u201d<\/p>\n<p>Just a day earlier, Kelly lashed out at Roberts and Barrett for siding with liberals in a separate ruling allowing states to count mail-in ballots postmarked on or before Election Day but arrive afterward.<\/p>\n<p>\u201cWhy are they always so wiggly?\u201d she said on her podcast. \u201cAmy Coney Barrett is a turncoat. She\u2019s constantly siding with the left.
