{"id":223,"date":"2026-05-29T04:45:10","date_gmt":"2026-05-29T04:45:10","guid":{"rendered":"https:\/\/nationwideinterstatemovers.com\/?p=223"},"modified":"2026-05-29T04:45:10","modified_gmt":"2026-05-29T04:45:10","slug":"scotus-justice-slams-colleagues-as-she-dissents-solo","status":"publish","type":"post","link":"https:\/\/nationwideinterstatemovers.com\/?p=223","title":{"rendered":"SCOTUS Justice Slams Colleagues as She Dissents Solo"},"content":{"rendered":"<article>\n<p>Supreme Court Justice Ketanji Brown Jackson blasted her colleagues in a fierce dissent on Thursday over a decision limiting how federal prisoners can seek early release.<\/p>\n<p>Read more <a href=\"https:\/\/nationwideinterstatemovers.com\/?p=221\">Trump Splashes Bonkers Amount of Cash on New Gold Makeover<\/a><\/p>\n<p>Jackson, who was appointed by the U.S. Supreme Court by former President Joe Biden in 2022, was the sole dissenter to a decision that found that alleged invalidities of a conviction are not a valid basis for compassionate release.<\/p>\n<div>\n<p>The court\u2019s conservative majority, led by Justice Amy Coney Barrett, argued that federal prisoners cannot use compassionate release motions\u2014which authorize district courts to permit reductions of federal prison sentences for \u201cextraordinary and compelling reasons\u201d\u2014to challenge the validity of their convictions.<\/p>\n<\/div>\n<p>\u201cThe compassionate release provision is not a vehicle for attacking the validity of a conviction,\u201d Barrett, who was appointed by President Donald Trump during his first term, wrote in the majority opinion.<\/p>\n<p>The court ruled that such claims must instead go through the traditional habeas corpus process, the customary procedure for post-conviction challenges.<\/p>\n<p>The case in question centered around Joe Fernandez, who is serving a life sentence for his alleged role as a backup shooter in a double assassination plot in the Bronx, New York, in 2000.<\/p>\n<p>Fernandez has repeatedly challenged his two consecutive life sentences since he was sentenced in 2013, seeking compassionate release through the argument that doubts about his guilt fall under the \u201cextraordinary and compelling reasons\u201d for a sentence reduction.<\/p>\n<p>A trial judge granted his release based on concerns about the validity of the conviction, but his release was reversed by Thursday\u2019s majority opinion.<\/p>\n<p>Read more <a href=\"https:\/\/nationwideinterstatemovers.com\/?p=219\">Trump Calls in Ghislaine Maxwell for a Favor in $10B Lawsuit<\/a><\/p>\n<p>While Jackson\u2019s liberal colleagues on the bench, Justices Sonia Sotomayor and Elena Kagan\u2014both appointed by former President Barack Obama\u2014agreed with Barrett\u2019s opinion that Fernandez\u2019s release should be overturned, they did not agree with the broader reasoning behind it.<\/p>\n<p>Jackson, however, fully disagreed with all of her colleagues on the bench. She argued that the language of the compassionate-release statute \u201cis no accident,\u201d and \u201creflects Congress\u2019s intent to preserve some of the traditional discretion afforded to district courts to ensure just treatment of defendants in criminal cases.\u201d<\/p>\n<p>\u201cToday, the Court arbitrarily restricts that discretion by grafting an atextual rule onto [the compassionate-release statute],\u201d Jackson, 55, wrote. \u201cIt holds that a district court may not base its \u2018extraordinary and compelling\u2019 findings on any reason that \u2018collaterally attacks the validity\u2019 of the prisoner\u2019s conviction.\u201d <\/p>\n<p><i>\u201d<\/i>Such \u2018attacks,\u2019 the majority says, must be brought through motions for habeas relief under 28 U.S.C. \u00a72255,&#8221; the Justice continued. \u201cBut this restriction comes out of nowhere\u2014it finds no support in the statute\u2019s text or history, nor can it be justified by our precedents.&#8221;<\/p>\n<p>\u201cWhat, then, explains the new categorical rule that the Court adopts today? The answer appears to be the majority\u2019s intuition that the District Court\u2019s grant of petitioner Joe Fernandez\u2019s compassionate-release motion qualifies as an abuse of discretion under the circumstances presented here,\u201d she added. \u201cThat may well be true\u2014but not because of an implicit, habeas-based limitation on the reach of [the compassionate-release statute].&#8221;<\/p>\n<div>\n<p>\u201cBecause the Court of Appeals erroneously relied on such a habeas-based rule in reversing the District Court\u2019s grant of compassionate release, and the majority now endorses that approach, I respectfully dissent.
